He is probably crying with your sister because she is not properly feeding him.  You really need to call CPS and file a report on your sister for two main reasons:  One you need to cover yourself in that you are reporting suspected abuse and two so that the abuse is documented.Should someone else call CPS on your sister and it is discovered that you were aware of this situation and did not report the abuse, CPS may not consider you for placement of the child and put him in foster care.Also should you decide to take her to court to sue her for custody of this child, it will help your case to have documented abuse.  Taking pictures of the home or keeping a journel is helpful but it is not always taken into consideration by anyone as it is not professionally documented and really could come back on you as you did report it.If CPS goes out to the home and finds that the child is at risk, they are going to be looking for relatives to take the child at least temporarily and try to work with your sister to teach her parenting skills and so on.  If your sister does not shape up and demonstrate she can care for the child and you are able to show that you can, CPS can help facilitate an adoption for you at little or no cost to you.  What you would need to know up front is that CPS will run background checks and assess your ability to care for this child.
